NON-BREEDING AND SALES AGREEMENT
FOR A WILDGOOSE NORFOLK/NORWICH TERRIER (version Aug 06)
1. Corinne Folger and Victor Sattler, of 39 Howden Road West, Oshawa, Ontario, Canada, L1H 7K4, e-mail: <info@wildgooseterriers.com> hereafter known as “the Breeders”, agree to sell a Norwich/Norfolk Terrier named:

2. The purchase date for this Norwich/Norfolk Terrier is day-month-year .
3. The Purchaser agrees to pay the Breeders $___________ as the purchase price of the Norwich/Norfolk Terrier. A non-refundable deposit of 25% of the purchase price is due to the Breeders once the pup is two weeks old. The balance is due to the Breeders one week prior to physical transfer of the dog from Breeder to Purchaser.
4. It is the responsibility of the Purchaser, in consultation with the Breeders, to make arrangements for the pick-up of the dog from the Breeders.
5. This agreement is hereby entered into in the City of Oshawa, Province of Ontario, Canada, between the Breeders and the Purchaser. Any legal disputes will be heard in this jurisdiction.
OUR WILDGOOSE GUARANTEE
6. Health. The Breeders guarantee the Norwich/Norfolk Terrier at the date of delivery to be in good health and free from communicable diseases as verified by our veterinarian on day-month-year. The Breeders agree to provide the Purchaser a written record of the Norwich/Norfolk Terrier’s vaccinations and de-worming program on the day the Norwich/Norfolk Terrier is transferred in ownership.
7. Temperament. The Breeders guarantees the Norwich/Norfolk Terrier to be of stable temperament and as outlined by the Canadian Kennel Club Norwich/Norfolk Terrier written breed standard.
8. Registration and Identification by Microchip. The Norwich/Norfolk Terrier is microchipped and is in the process of being registered with the Canadian Kennel Club (CKC) by the Breeders.
9. Debilitating Congenital Defect 2 Year Guarantee. If, within two years from the purchase date, the Norwich/Norfolk Terrier is diagnosed by the Purchaser’s veterinarian as having a severely debilitating congenital defect that, in the Breeder's opinion, prevents the Purchaser’s Norwich/Norfolk Terrier from serving them as a companion pet, upon presentation of a written diagnosis from said veterinarian, the Breeders will provide medical expenses not to exceed the purchase price agreed above or a replacement Norwich/Norfolk Terrier, the choice of which is to be determined by the Breeders. After the two-year period commencing from the purchase date, the Breeders do not assume any liability for veterinary bills or any related expenses resulting from any health condition.
10. 30 Day Return Policy. The Breeders will give a full refund to the Purchaser (less all associated costs of return transportation i.e. airfare, mileage, travel meals, accommodation etc., that will be borne by the owner) for any reason within thirty (30) days of the original purchase date of the Norwich/Norfolk Terrier.
11. As long as Wildgoose Terriers remains in existence, if Purchasers for any reason feel they can no longer keep their dog, it will be accepted back. There will be no monies paid to the Purchaser upon return of the dog, however the dog will remain either with the Breeders care or be placed into a carefully screened, caring home. The registration papers must be signed over to the Breeders. There is no age limit on the re-homing of the dog.
PURCHASER'S AGREEMENT
12. The Purchaser agrees that this dog is being sold under a Canadian/American Kennel Club Non-Breeding Agreement as a family companion, not for breeding purposes. The Purchaser agrees to sign the accompanying kennel club Non-breeding Agreement.
13. The Purchaser agrees to:
13.1. familiarize themselves and understand the nature of the breed of dog they purchased from the breeders;
13.2. provide a securely fenced area adjacent the Purchaser’s home for the Norwich/Norfolk Terrier to play and exercise in and not tie out or tether the dog;
13.3. keep this Norwich/Norfolk Terrier confined and under control (i.e. must not be allowed to run at large);
13.4. provide daily physical exercise for the health of the Norwich/Norfolk Terrier;
13.5. provide all routine, preventative and emergency veterinary care as required and recommended by the Purchaser's licensed veterinarian;
13.6. provide a premium nutritious diet to maintain a healthy life;
13.7. provide good and reasonable care including weekly grooming;
13.8. seek basic dog obedience training no later than the Norwich/Norfolk Terrier being 9 months of age (the sooner the better).
13.9 notify the Breeders of any change of address within 30 days of that change.
14. Initial Health Check. The Purchaser agrees to take this Norwich/Norfolk Terrier to a licensed veterinarian of his/her choice for a health check within 72 hours of receipt of the Norwich/Norfolk Terrier. Should the Norwich/Norfolk Terrier be determined to be in ill health, the cause of which is clearly attributable to the Breeders, the dog may, upon presentation of written diagnosis from said veterinarian to the Breeders, be returned for a refund of the purchase price or, pending availability, for another Norwich/Norfolk Terrier of equal value, the choice of which is to be determined by the Breeders. Any veterinarian's diagnosis shall be subject to confirmation by a veterinarian chosen by the Breeders. Should said veterinarian not concur with the diagnosis the matter shall be presented to a third veterinarian mutually agreed upon by the Breeders and the Purchaser.
15. Spay / Neuter. This Norwich/Norfolk Terrier is being sold with a CKC Non-breeding Agreement and is to be neutered by a Doctor of Veterinary Medicine no later than at 6 months of age for females and 12 months for males at the Purchaser’s expense. This Norwich/Norfolk Terrier is not to be bred under CKC rules or those rules of any other registry. Rescinding the Non-breeding Agreement requires the consent of both the Breeders and the Purchaser. If this Norwich/Norfolk Terrier is bred and/or produces a litter the Purchasers are responsible to the Breeders for breach of this contract and agree to pay damages to the Breeders.
16. Disposing of the dog. Should the Purchaser decide at any time to sell, give away, or otherwise dispose of this Norwich/Norfolk Terrier, the Norwich/Norfolk Terrier must be returned to the Breeders. The Purchaser further agree to complete and return to the breeders the dog’s CKC Registration with the "Application for Transfer of Ownership" completed in the breeders’ names, including the CKC Non-breeding Agreement, upon returning the Norwich/Norfolk Terrier.
17. In the event a replacement Norwich/Norfolk Terrier is warranted all transportation costs (i.e. airfare, mileage, travel meals, accommodation etc.,) incurred by the Breeders will be born by the Purchaser.
ADDITIONAL TERMS AND CONDITIONS
18. It is agreed that if this dog is seized by the Society for Prevention of Cruelty to Animals or other humane or animal control facility due to alleged cruelty, neglect or the like, where these claims are proven, the Purchaser acknowledge the Breeders full and indisputable right to reclaim the dog into the Breeders exclusive ownership and care without compensation to the Purchaser. Similarly, the failure of the Purchaser to comply with the care, neutering or placement of this Norwich/Norfolk Terrier could result in the return of the Norwich/Norfolk Terrier by the Purchaser to the Breeders without reimbursement of the original sale price of the Norwich/Norfolk Terrier.
19. Registered Name. The kennel prefix "Wildgoose" will be placed on the beginning of this Norwich/Norfolk Terrier's CKC registered name.
20. This contract is non-transferable and becomes void if the Norwich/Norfolk Terrier is sold or placed.
21. The Breeders neither makes nor imply any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the breeders and the Purchaser with respect to this sale.
22. We, the undersigned, have read, fully understand and agree to the terms and conditions of this contract.
